Sampling audio from previously published music is not new, and often done with the assumption that the action is protected under the public domain law which allows use of previously published or patented brands to be available for public manipulation after a lifespan of 20 years. Though when it's applied and success is achieved, someone always come along seeking a payout.

The entire music track for Will Smith's 1997 hit "Gettin Jiggy With It" is from the 1979 hit "He's The Greatest Dancer" by Sister Sledge. Most people born in the 1990s likely will think the whole track is original, having never heard of Sister Sledge. The catchy background chorus "na na na na na na" was sampled from the Bar Kays 1970 track called "Sang and Dance".

There are other less significant samples within the track such as "mammako mammasa mamma makosa" from 1972 "Soul Makosa" by Manu Dibango.
